1. Agreement to these terms
Lofee is an events and ticketing platform operated by two affiliated companies: Crayden Interactive Inc. in Canada and Crayden LLCin the United States (together "Crayden", "we", "us", or "our"). Your agreement is with Crayden Interactive Inc. if you live in Canada, and with Crayden LLC if you live in the United States or anywhere else. By creating an account, buying a ticket, or otherwise using Lofee, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the platform.
Lofee and Indie are two storefronts of the same platform. These terms apply to your use of either site, and an event may be visible on one or both depending on how its organizer publishes it.
2. Who can use the platform
You must be at least 13 years old (or the minimum age required in your jurisdiction) and able to form a binding contract to use Lofee. Organizer accounts (artists, businesses, promoters, and venues) must provide accurate business information and complete payment onboarding before selling tickets.
3. Your account
You are responsible for the accuracy of the information on your account and for keeping your sign-in credentials secure. Anything done through your account is treated as done by you. Tell us promptly through the contact form if you believe your account has been compromised.
4. Events and tickets
Events on Lofeeare created and run by independent organizers. We provide the marketplace, ticketing, and check-in tools, but we are not the organizer of any event and are not responsible for an event's content, quality, safety, cancellation, or rescheduling. Your ticket is a contract between you and the event's organizer.
Tickets are for personal use, may be subject to capacity and per-order limits set by the organizer, and may be invalidated if obtained fraudulently. Each ticket carries a unique QR code; admission may be refused if a ticket has already been checked in.
5. Payments, fees, and refunds
Payments are processed by Stripe. We charge a platform fee on ticket sales and organizers may choose whether platform and processing fees are absorbed or passed on to the buyer; any fees you pay are shown at checkout before you purchase. Applicable taxes are calculated based on the event's location.
Refunds are issued by the event's organizer under the organizer's own policy. If an event is cancelled, contact the organizer first; if you cannot resolve it with them, reach us through the contact form and we will try to help.
6. Organizer payouts
Organizers receive ticket revenue, less platform and processing fees and any refunds, through Stripe Connect after their event completes. Organizers are responsible for completing Stripe onboarding, for the accuracy of their payout details, and for their own tax obligations on event revenue.
7. Pro subscriptions
Pro is an optional paid subscription billed on a recurring basis through Stripe. You can cancel at any time and your subscription remains active until the end of the current billing period. Except where required by law, subscription payments already made are not refunded.
8. Advertising
Eligible accounts may submit ads for display on the platform. All ads are reviewed before running and we may reject or remove any ad at our discretion. Advertising is billed against prepaid credit as impressions are served. Contact us about any unused credit on your account.
9. Your content
You keep ownership of the content you post, including event listings, profiles, images, and messages. By posting it you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and distribute that content as needed to operate and promote the platform. You are responsible for having the rights to everything you post.
Music you upload to the radio is subject to the same terms: by submitting a recording you affirm that you wrote it or hold the rights to it, and you grant us a worldwide, non-exclusive, royalty-free licence to stream it on the platform. Uploads are reviewed before airing, and we may decline or remove any track at our discretion. You can remove your track at any time, which ends the streaming licence for it.
10. Acceptable use
You agree not to:
- post content that is unlawful, misleading, infringing, or harmful;
- resell tickets in violation of an organizer's terms or applicable law;
- circumvent fees, ticket limits, check-in, or any security measure;
- scrape, overload, or interfere with the platform or other users' use of it;
- impersonate any person or misrepresent your affiliation with anyone.
11. Termination
You may stop using the platform or ask us to close your account at any time. We may suspend or terminate accounts that violate these terms, create risk for other users, or are required to be closed by law. Sections that by their nature should survive, such as payment obligations, content licences, disclaimers, and limitations of liability, remain in effect after termination.
12. Disclaimers and limitation of liability
The platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from events run by organizers. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim and one hundred dollars.
13. Changes to these terms
We may update these terms from time to time. When we make material changes we will update the date at the top of this page and, where appropriate, notify you on the platform or by email. Continuing to use Lofee after changes take effect means you accept the updated terms.
14. Governing law
If your agreement is with Crayden Interactive Inc., these terms are governed by the laws of the province or territory where you live and the federal laws of Canada applicable there. If your agreement is with Crayden LLC, these terms are governed by the laws of the state where you live or, if you live outside the United States, the laws of the state where Crayden LLC is organized, in each case without regard to conflict-of-law rules.
